Privacy Policy
How we collect, use, share, and protect the information you provide through this website.
Last updated: July 1, 2026
Overview
This Privacy Policy explains how The Operating Point ("The Operating Point," "we," "us," or "our") handles information collected through this website, theoperatingpoint.com (the "Site"). We keep our data practices deliberately narrow: we collect what we need to respond to your inquiry and provide our services, and nothing more.
By using the Site or submitting the contact form, you agree to the practices described here.
Information we collect
Information you provide
When you submit the contact form, we collect the information you enter: your first name, last name, company name, email address, phone number (optional), and the details you share in the message field. Please share only what is necessary to describe your inquiry.
Information collected automatically
When you submit the form, we also record which page you submitted from, the service context, the page URL, and the date and time of submission, so we can respond in context. Our website host may automatically log standard technical information, such as IP address, browser type, and access times, for security and to operate the Site.
Cookies and tracking
As of the date above, the Site does not set tracking cookies and does not include analytics, advertising, or cross-site tracking scripts.
How we use your information
We use the information you provide to:
- Respond to your inquiry and communicate with you about it;
- Provide, scope, and deliver our services if we begin working together;
- Maintain the security and proper functioning of the Site; and
- Comply with our legal obligations.
We do not use your information for automated advertising, and we do not sell it.
How we share your information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only in these limited circumstances:
- Service providers. We use trusted providers to operate the Site and route inquiries. This includes our website host, Cloudflare; Zapier, which automates form-data notifications; and the email systems used to receive form submissions. These providers process information on our behalf and are limited to that purpose.
- Legal and safety reasons. We may disclose information if required by law, or to protect the rights, property, or safety of The Operating Point, our clients, or others.
- Business transfers. If the business is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction.
We do not disclose your personal information to third parties for those third parties' own direct marketing purposes.
Data retention
We keep the information you provide only as long as needed to respond to your inquiry and, if we work together, to provide our services and meet legal and recordkeeping requirements. Inquiries not resulting in an engagement are deleted within 24 months.
How we protect your information
The Site is served over an encrypted HTTPS connection, and we use reasonable administrative and technical measures to protect the information we hold. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
Your privacy rights
This Site and our services are intended for clients and prospective clients in the United States. Depending on the U.S. state where you live, you may have rights over your personal information, including the right to request access to it, correct it, ask us to delete it, and the right not to be discriminated against for exercising these rights. We do not sell personal information or share it for cross-context behavioral advertising.
California residents have specific rights under the California Consumer Privacy Act, as amended (CCPA/CPRA), including the rights to know, delete, and correct personal information, and to opt out of sale or sharing, which we do not do. Residents of other U.S. states with comprehensive privacy laws may have comparable rights. These rights vary by state and may depend on how the law applies to this business.
You may use an authorized agent to submit a request on your behalf, subject to our verifying the agent's authority to act for you.
To exercise any of these rights, contact us at katie@theoperatingpoint.com. We will respond as required by applicable law and may need to verify your identity before acting on a request.
International visitors
The Site and our services are intended for clients and prospective clients in the United States. We do not market or sell services outside the United States. The Site is operated in the United States, and any information you provide is processed in the United States.
Children's privacy
The Site is intended for business audiences and is not directed to children or anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
Links to other sites
The Site may link to third-party websites we do not control. This policy does not apply to those sites, and we are not responsible for their practices. Review their privacy policies before providing information.
Changes to this policy
We may update this policy from time to time. When we do, we will revise the "Last updated" date above. Material changes will be reflected here, and your continued use of the Site after an update means you accept the revised policy.
We review this policy at least annually.
